Bloated Bureaucracy (ANSWERED)

QUESTION

For the initial post, respond to one of the following options, and label the beginning of your post indicating either Option 1 or Option 2:

  • Option 1: How does the bureaucracy affect your life, and thus, your freedom as an ordinary citizen? In what ways does it hinder or help your life? Do you see the bureaucracy as an effective aspect in your life or do you see issues with the bureaucracy as it stands? Why/why not? List one issue you would change concerning the bureaucracy and how you would remedy the issue.
  • Option 2: Identify a recent decision by the U.S. Supreme Court and discuss the nature of the case and the basis of the argument the Supreme Court used to reach the decision. Explain why you agree or disagree with the ruling?

ANSWER

Option 1

The office organizational mode and bureaucracy are dominant nowadays. Most Americans work in bureaucratic settings, be it in the government, hospitals, or colleges. Bureaucracy has both positive and negative effects on the daily lives of citizens. Bureaucracy receives a lot of criticism due to its clear hierarchies that dictate a clear division of labor and strict policies that implicate consequences for defaulters. However, bureaucracy is built to emphasize equality which gives it several advantages.

Bureaucracy requires responsibility and accountability. People who work in the bureaucratic structure are often highly educated, open-minded, and self-direction. Working in such an environment motivates me and makes me more focused. It makes me focus more on the general good when I work in other settings. Bureaucracy also ensures that I have job security. All I need to do is follow the directions of the bureaucratic structure, and I am sure that my job tenancy is guaranteed. The chances of success are equal for all workers depending on their performance. There is little favoritism in a bureaucratic structure. The setting emphasizes equality, making it optimal for any citizen to achieve their goals.

The main drawback I experience in the bureaucratic structure is being compelled to follow strict guidelines. Any innovations that I put in improving the functionality or operations of the institution must go through several auditions for it to be approved (Gold, 2019). I believe that such auditions and approval requirements reduce my productivity and innovation capabilities. It may also lead to poor financial management whereby budget allocations are left to appointed officials who are less interested in how the money is spent and how they make personal gains from it. Overall the advantages of bureaucracy outweigh the disadvantages.

Option 2

The Biden et al. v. Texas et al. was related to immigration and administrative law, and the United States Supreme Court held it. The court case followed the promulgation of the Migrant Protection Policy (MPP), commonly called the Remain in Mexico policy, by the United States Department of Homeland Security. The policy required Mexicans seeking asylum in the US to remain in their country until their cases had been reviewed. The United States Court of Appeals for the Ninth Circuit claimed a disposition for the appeal in May 2019. The federal government requested for the Supreme Court of the United States writ of certiorari.

The panel approved the request, but the Supreme Court approved it. The case was held at abeyance after Joe Biden was sworn in as president in January 2021. Missouri and Texas Challenged the MPP’s rescission in April 2021, and the United States District Court for the Northern District of Texas held that it was arbitrary and capricious. Judge Matthew J. Kacsmaryk agreed with the states’ claims that asylum seekers increase the costs of running operations or resource allocation in the states. The Supreme Court and The United States Court of Appeals for the Fifth Circuit rejected pending appeals.

The Supreme Court granted certiorari that the federal government issued following the rulings. It held arguments on April 26, 2022, and reversed the judgment on June 30, 2022. The Supreme court held that the president has the authority to end protocols following guidelines of the Immigration and Nationality Act of 1996 (Leagle, 2022). The ruling of the Supreme Court followed all the legal requirements, considered all the parties involved, and based its verdict on sound judgment. Reversing the ruling of the previous court’s rulings was founded on legal and ethical judgment. The government, individuals, states, and citizens should show the moral responsibility of ensuring that all people within and outside the country are protected from harm.
